Well, recently one of my friends mentioned that she’s going through a very messy devoice, because her husband comed infidelity. And now they are battling about the custody of their only son.
Well, that’s right. You got it. We are gonna talk about devoice.
Then what exactly does devoice mean?
Well, when a married couple do not want to be married any more, this means that they want to bring an end to their marriage. They get devoiced. And that’s in the eyes of the law. Right ? That is what we mean by devoice.
Well there is something called trial separation.
What does trial separation mean?
At times you may have heard people saying she‘s just separated from her husband.
Well, this means the couple is not legally devoiced. They are just separated. They are living apart.
Ok. There are sorting out their differences. Maybe they are working out whatever issues that they are facing as a couple. Ok. That’s when they are on a trail separation.
And that you may never know they might reconcile. Reconcile means they might get back together so the moment they sort out their differences they might get back together. Right. Now we also have something called annulment. Annulment is a little different from a devoice. It’s an official statement which means the marriage was never real. This means that the marriage was completely invalid. So the marriage is void.
There are certain reasons why marriage can be invalid. Er, if one of the partners was married already before he’s getting into this marriage, ok so then the marriage is void. That means, isn’t it. Like the partner already get married and you are getting into another marriage. Wow, well, there is another reason also if one of the partners is forced to get married or if it is compiled to get married, it means the marriage won’t be called as a devoice, but it would be called as an annulment. Ok? Because the marriage is invalid.
Ok. Now there is a certain procedure to devoice. Now Basically once the couple decides they want to file for a devoice, they would go ahead. File for a devoice means they would submit leagal documentation, the legal paper to the local government. ok and they would hire a devoice lawyer. Individually they would have their own lawyers who would figure out how they gonna divide the assets. Now as a couple, I’m sure they will have a house, a lot of money would be involved. That has to be divided, isn’t it. Basically that’s the work of a devoice lawyer who would work who would figure out how’s gonna be divided. Now there are two options for the couple, they either go to the court ok so that’s a devoice/court, ok?
Also called this family court in many countries. They have a judge who decides on the devoice.
Or they settle it out of the court. Settling out of the court means er they would solve their issues I mean what however the assets had to be divided or any kind of disputes would be solved together out of the court. Like it would be solved amicably. Right. So that means they would not be going to the judge. They do not want to go through the hustle of the traditional custody.
Ok. Then we also have finalizing the devoice. That’s the end part of the devoice. Basically when the whole devoice agreement is ready, the couple will finalize the devoice by signing some set of papers. Ok. So once that signed this means the marriage is over. Ok, the show is stop. So that is finalizing the devoice.
And then we have alimony. Alimony is basically a law enforced payment that has to be made by one of the partners, by one partner to the, to the other like the husband would have either the husband or the wife whoever owns better would pay the alimony.
Many countries call this alimony.
Also call this maintenance.
Or it calls this spouse support.
Ok. So that is what is alimony.
Now let’s look at some things what happen when the couple filing for a devoice and they have children. So let’s see how the procedure goes on. Now let’s see what happens to the couple who decides to get devoiced and have children. That kind becomes kind of tricky,isn’t it? Because all parents love their children, so how the procedure goes about we’ll have a look.
Now to get custody. To get custody means which parent gets to keep their child. Ok. So that’s exactly what they do. They decide who will get the custody of the child, with whom the child would live. Ok. Now we have full custody which means in the eyes of law, a full custody means the child would live with one parent forever. Ok. So if the mother gets the custody, if the wife gets the full custody which means the child or children would get to live with the wife, or with the mother forever. Ok. But there are also something called as visitation rights. Now visitation rights mean the law gives certain days wherein the other parent gets to visit the child or children. So for example, if the mother gets the custody of the children, ok, then the father would get some visitation rights. He would visit certain days or maybe once a month or once a week whatever the law decides. And that’s called that visitation rights
Ok. Then we have joint custody. Now joint custody means I feel that is the best ok. Joint custody means wherein both of the parents, ok, get the custody of the child. This means maybe according to the law whatever the law decides maybe the mother would get to live the children a week, and the next week they are with the father.
Or for a couple of moths they are with their mother
And then for a couple or the rest of the time they are with their father
Ok. That means joint custody
Ok. Then we have a custody battle
Now custody battle, er, trust me, is a little stressful
Especially for the couple firstly they are getting devoiced and then they are trying to fight for the custody for their children
Ok. It’s get really stressful for parents and for the children.
SIt means they are not able to come onto the conclusion who will get the custody. It’s completely a battle , a fight over their children.
Sp that it is they go through a custody battle. And then we have child support. Now child support is not similar to alimony. Child support is a completely different thing. Child support means, a parent, ok. For example, if the mother gets the full custody, then the father has to pay for child support, ok. He has to pay some maintenance in order to raise the kids. All right. So that means child support.
